Gratuity is a statutory monetary benefit paid by an employer to an employee as a mark of appreciation for long-term service. It is governed by labor laws and is typically payable when an employee leaves an organization after completing a specified minimum period of continuous service.

What Is Gratuity?

Gratuity is a lump-sum payment made to employees who have rendered continuous service to an organization for a minimum number of years. It is paid at the time of retirement, resignation, termination, or in the event of death or permanent disablement.

Eligibility for Gratuity

An employee becomes eligible for gratuity when:

  • They have completed the required period of continuous service
  • They leave the organization due to resignation, retirement, or termination
  • In case of death or disablement, the service period condition may not apply

Gratuity Calculation

Gratuity is generally calculated based on the employee’s last drawn salary and years of service.

Standard Formula:
Gratuity = (Last drawn salary × 15 × Number of completed years of service) ÷ 26

Here, salary typically includes basic pay and applicable allowances.

When Is Gratuity Paid?

Gratuity is payable in situations such as:

  • Retirement
  • Voluntary resignation
  • Superannuation
  • Death of the employee
  • Permanent disability
